Welcome to Nadine Werjant! The terms “I”, “me”, and “my” refer to Nadine Werjant.

I operate this shop and this website, including all associated information, content, features, tools, products, and services (the “Services”).

These General Terms and Conditions (“Terms”) govern the contractual relationship between you as the customer and me as the provider. They apply to all orders placed through my online shop.

Please read these Terms carefully. By placing an order, you accept these Terms as well as my Privacy Policy, Right of Withdrawal Policy, and Shipping Policy.

Section 1
Access and Account

• By agreeing to these Terms, you confirm that you are of legal age in your country of residence.
• An account may be required to use certain Services. You agree to provide truthful information when creating an account.
• You are responsible for keeping your login details confidential and are liable for all actions carried out through your account. Transferring your account to third parties is not permitted.

Section 2
My Products

• I offer both handmade originals and one-of-a-kind pieces as well as print-on-demand products.
• For print-on-demand items, production only begins after the order has been placed. Due to their individual production, these products may be excluded from the statutory right of withdrawal.
• I make every effort to display all products as accurately as possible. Variations in colors or appearance due to different screen settings are possible.
• Product descriptions, prices, and availability may be changed at any time. I reserve the right to remove products from the range or limit quantities.

Section 3
Orders and Conclusion of Contract

• By placing your order, you submit a binding offer to conclude a purchase contract.
• The contract is concluded when I confirm your order by email.
• Before submitting your order, you will receive an overview of all order details during checkout. You can correct any errors there.
• Orders are intended for private use only. Resale for commercial purposes is prohibited.
• Returns or exchanges are handled exclusively in accordance with my Right of Withdrawal Policy.

Section 4
Prices and Billing

• All prices are stated in euros and include statutory VAT.
• Shipping costs are shown separately at checkout.
• The available payment methods are displayed at checkout. By placing your order, you confirm that you are authorized to use the selected payment method.
• Payments are due immediately upon conclusion of the contract.

Section 5
Shipping and Delivery

• Shipping is carried out exclusively within the European Union. No customs duties or import charges apply.
• Originals/handmade items: shipped directly from Vienna, processing approx. 2–5 business days, shipping time approx. 3–7 business days.
• Print-on-demand products: production 2–7 business days, shipping within the EU approx. 2–8 business days, total delivery time 4–13 business days.
• Partial deliveries may occur at no additional cost to you.
• Delivery times are estimates. I am not liable for delays caused by shipping providers or circumstances beyond my control.

Intellectual Property

All content in my shop, including texts, images, designs, and logos, is protected by copyright. It may not be reproduced or used commercially without my written consent.

Section 7
Optional Tools

I may provide tools from third-party providers, such as Shopify plugins. You use these at your own risk. I accept no responsibility for their functionality or security.

Section 8
Third-Party Links

My website may contain links to third-party websites. I accept no liability for their content or privacy practices. Contracts you enter into with third parties are concluded exclusively between you and those providers.

Section 9
Relationship with Shopify

My shop is operated through Shopify. Contracts for purchases are concluded exclusively between you and me. Shopify is not a contractual party and accepts no liability for my products or Services.

Section 10
Privacy Policy

Personal data is processed in accordance with my Privacy Policy. As my shop is operated through Shopify, data may also be processed by Shopify.

Section 11
Feedback

If you submit feedback or reviews, I may use them free of charge as part of my offering. You confirm that you own the rights to them and that no third-party rights are infringed.

Section 12
Errors, Inaccuracies, and Omissions

Errors or inaccuracies may occasionally occur, for example regarding prices or availability. I reserve the right to correct such errors at any time or to cancel orders.

Section 13
Prohibited Uses

It is prohibited to misuse the shop, in particular through:

• unlawful or fraudulent actions
• infringements of intellectual property rights
• transmission of malware or spam
• false or misleading information

In the event of violations, I may block access and take legal action.

Section 14
Termination of the Contractual Relationship

I may terminate the contract or access to my shop at any time if you violate these Terms. Payments due up to that point remain payable.

Section 15
Disclaimer of Warranty

• I make every effort to provide accurate information. However, I do not guarantee completeness or freedom from errors.
• All products are subject to statutory warranty rights.

Section 16
Limitation of Liability

• I am fully liable for intent, gross negligence, and damages to life, body, and health.
• In cases of slight negligence, I am liable only for damages resulting from the breach of essential contractual obligations (“cardinal obligations”) and limited to foreseeable damage.
• Any further liability is excluded.

Section 17
Indemnification

You indemnify me against all third-party claims arising from culpable violations by you of these Terms or applicable law.

Section 18
Severability Clause

If individual provisions of these Terms are invalid, the validity of the remaining provisions remains unaffected.

Section 19
Waiver Clause, Entire Agreement

Failure to assert individual rights does not constitute a waiver. These Terms constitute the entire agreement between you and me.

Section 20
Assignment

An assignment of your rights under this contract without my consent is not permitted.

Section 21

Applicable Law and Dispute Resolution

• Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
• For consumers, the statutory place of jurisdiction is the customer’s place of residence.
• Notice regarding EU online dispute resolution: The European Commission provides a platform for online dispute resolution, which you can find at https://ec.europa.eu/consumers/odr/. I am not obliged to participate in dispute resolution proceedings before a consumer arbitration board, but I am willing to do so.

Headings are for clarity only and have no legal effect.

Changes to the Terms

I may amend these Terms at any time. The version valid at the time of the order is decisive. I will inform you of significant changes in accordance with legal requirements.
